   1.1.3. "Terms and Conditions" are to be mentioned hereinafter as "Terms"

   1.1.4. "Domain(s)" is/are to be used to describe website domains which transfer is a part of the Services according to these Terms

   1.1.5. "GoDaddy" is to be used to describe General Terms, are provided by the GoDaddy.com, LLC

   1.1.6. "Services" are referring to the Domain transferring activities regulated by these Terms

   1.1.7. "1and1.com" is to be used to describe Terms provided by the 1and1.com

  1.2. You are hereby strongly recommended to carefully examine these Terms prior to the use of Services as being described hereby. Please be advised that these Terms may influence your usage of the Platform and its associated services including all obligations and legal consequences as being described hereby.

  1.3. The purpose of these Terms is to regulate the obligations, rights, commercial and legal relationship between the Provider and Users in relation to these Services as being regulated hereby.

2. Use and Services

  2.1. You are hereby to express your unconditional, direct and explicit consent that you will use the Services in a way of complete and absolute accordance with these Terms.

  2.2. The Provider grants its Users with a right to transfer the specific Domain they wish to acquire into their exclusive and transferable ownership.

  2.3. Please note that the Provider can transfer you ONLY the ownership rights associated with the Domain. We do not provide hosting, web design or any other Domain related Services.

  2.4. Please note that you may be required to renew your Domain registration after the current expiry term. By using these Services, you are obtaining the ownership of the Domain you are trying to acquire for a LIMITED period of time.

  2.5. The Users are allowed to make derivative commercial or any other similar use of the Domain once they are obtained in a complete accordance with these Terms.

  2.6. The Domain you wish to acquire is the exclusive property of the Provider, until the moment you successfully purchase it, and not a single part of the Domain may be duplicated, copied, resold, or in other way commercially exploited or used without the previous successful transfer, which is approved by the Provider.

  2.7. Any unauthorized use of these Services may terminate your rights according to these Terms which can be followed by the appropriate legal measures.

  2.8. The Users are required to use the Services in an absolute accordance with the following:

   2.8.1. The applicable law or regulation

   2.8.2. The copyrights, trademarks, or other relevant intellectual property rights

   2.8.3. The Terms issued by Provider, GoDaddy, and 1and1.com

  2.9. The Users are to accept direct and unconditional responsibility for the Domain's usage once it has been obtained in a complete accordance with these Terms.

  2.10. You are hereby not to misuse the Services in any way against these Terms.

  2.11. Through the usage of the Services as being described and regulated hereby you are accepting the obligations, duties and consequences of these Terms explicitly and categorically.

  2.12. The Provider reserves an exclusive and discretion right to terminate or cancel the Services at any moment in cases of violation of these Terms by the Users.

  2.13. The Provider reserves an exclusive and discretion right to alter, modify or delete these Terms completely or partially with no obligation to inform its Users every time when these changes occur.

  2.14. By accepting these Terms you are making a statement about your complete awareness that you are fully aware about all of its sections, regulations and articles.

  2.15. The Provider does not guarantee that the information presented or advice in the form of the Services is absolutely precise, accurate, valid or in any other way in the complete accordance with your expectations.

  2.16. All material, information, pictures and similar associated with these Services are presented, provided and used exclusively according to the principle AS THEY ARE with no exceptions.

  2.17. The only option provided for you to express your disapproval or dissatisfaction with these Terms or Services is to prevent Yourself from any further use of our Services.

  2.18. In order to ensure the use of all the Service's opportunities all Users are required to comply with these Terms and Provider's instructions.

  2.19. Any third party link, hyperlink or information associated with the Services is beyond our control or influence. Therefore, we are not to be held liable in any circumstances for these elements as being described hereby.

  2.20. By accepting these Terms you are hereby accepting an obligation to use only the tools and features provided by the Provider and intended for these Services only.

  2.21. The Provider has the exclusive, unconditional and permanent ownership right over the Domain until you obtain it by using our Services.

  2.22. The Users are fully obliged to use the Domain and Services according to the instructions provided by the Provider. In addition, it is the Users' obligation to ensure that the Domain is being used according to technical requirements, including appropriate software requirements and instructions issued by the Provider until the moment they acquire it. Once the transfer of the Domain is complete the Users have an absolute freedom to use or resell the Domain as they wish.

  2.23. You as a User are accepting the full responsibility for the proper use of the Domain itself.

  2.24. You as a User are accepting that these Terms are excluding the Provider from the responsibility for the issues which are not directly associated to the Domain itself and its proper use.

  2.25. The features of the Services can be changed from time to time. The Provider has no obligation to inform the Users every time these changes occur. It is the Users' responsibility to inform regularly about the possible changes.

  2.26. Please note that more than User can be interested in transferring the same Domain. In case some other User has acquired a Domain before your request is complete you will be entitled to a refund within 15 working day time period.

  2.27. Please note that you may be required to create an account according to GoDaddy's and/or 1and1.com Terms in order to successfully use our Services.

  2.28. Please note that the transfer process associated with the Domain you wish to acquire after you conduct a payment will take as much time as required according to the requirements of godaddy.com or 1and1.com. We are excluded from any responsibility or your complaints in this matter.

  2.29. Please note that you may be entitled to a refund in the following cases:

   2.29.1. If there is an issues associated with the transfer process for which   you are not responsible

   2.29.2. If the Domain you paid for has already become an ownership of some other User due to the simultaneous purchase issues.

  2.30. Please note that in all other cases a refund will not possible, and the Domain transfer including your payment associated with it will be treated as a final one.

3. Liability Limitations of the Provider

  3.1. The liability of the Provider is strictly limited to these Services as being described in these Terms.

  3.2. The Provider cannot be held liable under any circumstances for the issues outside the Services themselves.

  3.3. The Users are hereby accepting that the Provider cannot to be held liable for any direct or indirect, explicit or implicit, incidental or unintentional, general or specific, loss or damage that can be associated to one of the following situations:

   3.3.1. The unavailability of the Domain regardless of the causes

   3.3.2. The failure of third parties involved in any way to the Services' functioning

   3.3.3. Unauthorized activities related to the use of the Domain and/or Services

   3.3.4. Any other situation that could not be predicted, prevented, or avoided at the moment you obtained the Domain

  3.4. The only option available to the Users to express their dissatisfaction  or disapproval with these Terms or the Services is not to use them.

  3.5. The Provider cannot be held liable for exercising its exclusive and discretion right to cancel or terminate the Services at any given moment, including the Users' claims for a potential damage or losses in this matter that can be associated to the Domain itself.

  3.6. You are hereby accepting the full responsibility for your use of the Services, including all issues or consequences associated with them.

  3.7. The Provider will not be held liable under no circumstances for any potential damages or losses that can be associated directly or indirectly, explicitly or implicitly to the Services and/or its use including the associated Domain.

  3.8. You are to exclude the Provider from any complaints, claims, costs, and liabilities explicitly or implicitly, directly or indirectly associated with the Services, Domain and Terms themselves.

  3.9. You are hereby to exclude the Provider from any responsibility related to any delay or inability to ensure some the functionality of some of the Services' features due the reasons that could not be prevented, avoided or predicted despite our greatest care, attention, or efforts.

4. Warranty Disclaimer

  4.1. All Users are accepting the Services AS THEY ARE and entirely at their own risk. Additionally, the Provider cannot to be held liable for the warranties of any kind, explicit or implied, direct or indirect, including but not necessarily limited to the understandable warranties for a particular specified purpose and/or non-infringement.

  4.2. We include no warranties that our Services, including the Domain itself will necessarily meet your expectations and results you are expecting. Additionally, our warranties do not include situations of unintentional interruptions, blockades, or termination of transfers of the Domain or availability of the Services which are beyond our control and influence.

  4.3. Please note that we are taking all the measures possible to prevent hackers' attacks, malware and virus threats through the provision of the Services. However, we cannot guarantee with an absolute certainty that these unwanted events will not take place at any point in time, despite our best efforts and intentions to prevent and avoid them.

  4.4. Under no circumstances will the information obtained from us through the use of the Services or the Domain itself create a legal ground for a potential warranty of any kind at any time.

5. Third-Parties Related

  5.1. Please note that we may use links and hyperlinks to the third party websites and applications. You are strongly advised to inform yourself about the Terms and Conditions associated with these sites and applications. They may differ significantly from the rules of these Terms.

  5.2. You are hereby to exclude the Provider from any responsibility for the actions of third parties that are required for the functioning of these Services and the Domain in question.

6. Copyright and Intellectual Property Related

  6.1. The Provider cannot be held liable under any circumstances for the copyright or intellectual property issues related to the Domain being transferred or used through the Services.

  6.2. The Users with a direct interest in the Domain being transferred through our Services are hereby accepting the full and unconditional responsibility for these materials for any potential copyright or intellectual property related issues, claims, or legal proceedings.

  6.3. The Provider and its employees, or other third parties associated to its activities are excluded from any responsibility for the copyright or intellectual property issues that can be associated with the Domain itself.

7. Miscellaneous and Closing Regulations

  7.1. These Terms are to be regulated and governed by an exclusive jurisdiction of the US Law and Courts. Any potential dispute or issues derived from or related to these Terms is to be addressed directly to the courts of New Jersey, USA.

  7.2. All Users are strongly advised to try reaching a settlement by the means of mediation and/or negotiation related to the issues or disputes derived from these Terms, before addressing the court as the final legal instance.

  7.3. These Terms between you and the Provider which regulate the issues and situations herein described and explained are to supersede any other agreement or document previously signed or accepted, in written or oral form, between you and the Provider.

  7.4. By accepting these Terms, all Users are to accept the limitless and unconditional presumption that they are fully and completely aware of all Terms sections, articles and regulations.

  7.5. Any failure of the Provider to exercise a certain obligation or right as described and explained in these Terms under no circumstances cannot be a waiver of these obligations or rights.

  7.6. If under certain circumstances and in some cases, any parts or sections of these Terms are to become invalid or unenforceable regardless of reasons, the parts or sections which are to remain are to be still fully obligatory with no exceptions.

  7.7. By accepting these Terms, all Users are to fully comply with the requirement, that any dispute, request, claim or some other issue which may arise from or be associated to these Terms are to be filed and examined within the period of up to one year from the moment they were discussed for the very first time. After one year they are to be treated as successfully solved and closed regardless of the current state of affairs, including the exclusion of possibility for their reopening and reexamining.

  7.8. Under no circumstances will the Provider will be held responsible for any action from you that is related to the Services and/or the Domain itself.
